On June 28, 2006, the Supreme Judicial Court amended Rule 4:02 to require active attorneys to certify to the Board of Bar Overseers whether or not they are covered by professional liability insurance.
Beginning with the September 2006 billing cycle, the information will be collected as part of the annual attorney registration process. Registration statements will include a question concerning whether or not an attorney has professional liability insurance. The registration of any attorney who does not answer this question will be considered incomplete. The attorney will be sent a letter advising that registration is incomplete, and no bar card will be issued until the information is provided. The text of the amendment may be reviewed here.
Professional liability insurance information will be made available for telephone inquiries. However, the registration website will not include the information until all four billing cycles are complete for FY2007.
